TAWALA SURFING MIND provides accommodation, surf, yoga and leisure activity services in Tamraght, Morocco.

 

2. Purpose and Scope

These General Terms and Conditions (GTC) define the terms of booking, payment, cancellation, liability and stay conditions applicable to the services provided by TAWALA SURFING MIND (hereinafter “TAWALA”).

Any booking implies full and unconditional acceptance of these Terms and Conditions.

 

3. Booking

A booking becomes binding after:

• payment of the deposit referred to in Article 4, and

• written confirmation sent by TAWALA (email or invoice).

TAWALA reserves the right to refuse a booking for reasons related to capacity, consistency, safety or organization.

 

4. Prices, Taxes and Payment Terms

 

4.1 Prices

Prices are displayed in euros (€).
Payments may be made:

• in euros (€), or

• in Moroccan dirhams (MAD), based on the exchange rate of the day communicated by TAWALA.

Prices do not include local or tourist taxes, when applicable.

 

4.2 Deposit

A deposit of 35% of the total stay amount is required to confirm the booking.
This deposit is non-refundable, except in the event of cancellation of the stay by TAWALA.

 

4.3 Balance

The balance of the stay must be paid no later than the day of arrival via a payment link.
In the event of non-payment within this timeframe, TAWALA reserves the right to cancel the booking and apply the cancellation conditions set out in Article 5.

Exceptionally, if TAWALA explicitly agrees to on-site payment, the balance must be paid at check-in, in cash.

 

5. Cancellation – No Show – Early Departure

 

5.1 Cancellation by the Client

Any cancellation must be notified in writing.

• More than 45 days before arrival: deposit retained.

• Between 45 and 30 days before arrival: 50% of the total stay amount is due.

• Less than 30 days before arrival: 100% of the total stay amount is due.

In the event of a no show or early departure, no refund will be granted.

 

5.2 Cancellation by TAWALA

In the event of total cancellation of the stay by TAWALA (excluding force majeure), all amounts paid will be fully refunded, except in cases of non-payment of the booking, in which case the deposit will be retained.

 

6. Activities – Surf – Yoga – External Conditions

Activities are subject to weather, ocean, logistical and safety conditions.

TAWALA reserves the right to modify, postpone or cancel any activity at any time for safety or force majeure reasons.

No cancellation or modification of activities, including surf sessions, shall give rise to any refund, whether partial or full, regardless of external conditions.

 

7. Children & Minors

TAWALA welcomes solo travelers, couples, groups of friends and families.
However, the riad, its common areas, swimming pool and activities are not specifically designed for children’s safety.

Children remain under the sole responsibility of their parents or legal guardians throughout the entire stay.
TAWALA cannot be held liable in the event of accident, injury or incident involving a minor.

Children under the age of 15 must be supervised at all times, in order to ensure their safety and the comfort of other guests.
TAWALA reserves the right to restrict access to certain areas or activities when deemed inappropriate or for safety reasons.

Surf and Sports Activities – Minors

• Children must be able to swim and feel comfortable in an aquatic environment.

• Access to surf activities depends on age, level, ocean conditions and the team’s assessment.

• Children must be accompanied by a responsible adult, according to the conditions defined by TAWALA.

• TAWALA reserves the right to refuse access to any activity if safety conditions are not met.

 

8. Insurance – Health – Personal Responsibility

The activities offered involve inherent risks.
Each client undertakes to have personal insurance covering travel, civil liability, sports and water activities, as well as medical expenses and repatriation.

The client declares that they are physically fit to participate in the booked activities.

 

9. Damage – Loss – Theft

The client is responsible for any damage caused to TAWALA’s property, equipment or facilities during their stay.
Repair or replacement costs will be charged to the client.

TAWALA declines all responsibility in case of loss, theft or damage to guests’ personal belongings.

 

10. Conduct and Exclusion

Any inappropriate, dangerous or disrespectful behavior may result in immediate exclusion from the stay, without refund, and without prejudice to possible legal action or invoicing for damages caused.

 

11. Personal Data

Personal data is used solely for booking management and customer relations.

12. Applicable Law – Jurisdiction

These Terms and Conditions are governed by Moroccan law.
Any dispute shall fall under the exclusive jurisdiction of the Moroccan courts.

 

13. Acceptance

By booking a stay or activity with TAWALA SURFING MIND, the client acknowledges having read, understood and accepted these Terms and Conditions.
